About this draft
- This is version 2026-10-21.2, a plain-English draft pending legal review. It has not been reviewed by a lawyer.
- The site terms (billing, renewals, cancellations, refunds) also apply.
Who the agreement is between
- Incumbent, LLC (“Incumbent”, “we”) and the organization or person that bought the Newsroom plan (the “licensee”, “you”).
Who may use it
- One person: you, the buyer. The sign-in is yours and may not be shared.
- Need more people? The Campaign and PAC plans include invited seats.
What you may do
- Quote any yea, nay, present, or not-voting position, tally, party-unity figure, or party-break count from the Incumbent ledger, in any medium, with attribution.
- Republish tables and charts you build from the roster and roll-call exports and the desk reports, in your own publications, with attribution.
- Embed Incumbent vote cards (member and bill cards) on the websites you register in your account, using the snippet from your account unchanged. Embed terms are below.
- Use the exports and desk reports for reporting, editing, fact-checking, and research by the one licensed person.
What you may not do
- Change, omit, reweight, or selectively relabel a recorded vote, or present a changed number as Incumbent’s.
- Say or suggest that Incumbent endorses, opposes, or works with any candidate, party, committee, or expenditure.
- Resell or sublicense the exports, post them for download, or offer them, or a copy of the ledger, as a dataset or feed of your own.
- Hide, cover, restyle, or remove the attribution badge on an embedded card, or change the numbers it shows.
- Use the material in paid political advertising, campaign mail, or fundraising. Those uses need a Campaign or PAC license.
- Share the export files or the sign-in with anyone else.
Attribution
- Credit Incumbent wherever you use the numbers: “Data: incumbent.vote” or “Source: Incumbent (incumbent.vote)”. Online, link it to incumbent.vote or the member or bill page.
- Where a single vote is the point, also cite the official roll call (House Clerk or Senate), which is linked on every bill page.
- In broadcast or audio, say or show “incumbent.vote”. In print or mail, print it near the number.
- Embedded cards carry the attribution badge already. It must stay visible.
Embed terms
- Embed codes come from your account and only work for the card they were made for. Use the iframe or script snippet as given.
- Register the websites that will show your cards. When you register sites, cards only display on those sites. With no sites registered, a card displays wherever the snippet is placed, so register your sites.
- Cards update on their own when the ledger or the official record changes. Do not copy a card's numbers into a static image and present it as live.
- When your license ends, or a key is replaced or revoked, cards made under it show a “license required” notice instead of the numbers.
- To check that a card is licensed, Incumbent reads the address of the page showing it, as browsers send it. Embedded cards set no cookies and run no tracking.
- Embeds are provided as is, with no uptime guarantee. Incumbent may change the card design but will keep the numbers and the attribution badge.
The data
- Positions come from the official House Clerk and Senate roll-call records. If Incumbent and the official record differ, the official record governs. Fixes are listed on the corrections page.
- The ledger is a curated set of scored votes, not a complete floor history. It is provided as is, without warranties.
- Incumbent sells no private tally. Licensees get the same numbers every voter sees.
How long it lasts
- The license runs while the Newsroom subscription is paid. It ends when the subscription ends, or if this agreement is broken.
- Material you published while licensed may stay published. Embedded cards stop showing numbers when the license ends.
- Billing, cancellation, and refunds follow the site terms.
Changes to this agreement
- Each version has a number and date, shown at the top. Your acceptance is recorded with the version, the date, and the exact text.
- If a new version changes your rights, you will be asked to accept it the next time you open the desk. Until you do, the desk and exports pause; you can cancel instead under the site terms. Embedded cards keep working while the subscription is paid.
